These Terms of Use, Privacy Policy, Cancellation and Refund Policy (“Terms”) govern your access to and use of the SuiFit website, mobile applications, digital services, fitness programs, content, subscriptions, and related features.

By accessing or using SuiFit, creating an account, subscribing to a service, or completing a purchase, you acknowledge that you have read, understood, and agreed to these Terms, subject to any mandatory rights granted to you under the laws and regulations of the Kingdom of Saudi Arabia.

2. About SuiFit and Our Services

SuiFit is a digital fitness and wellness platform designed to help users improve their physical fitness, exercise habits, and overall activity through digital tools and content.

Depending on the product, subscription, or features available, SuiFit may provide:

• Exercise recommendations.
• Fitness and performance tracking.

• Artificial intelligence-powered features.
• Fitness and activity data analysis.
• Body image upload and analysis features.

Available features may vary depending on the subscription plan, device, software version, or geographic location.

3. Eligibility and Account Registration

You must be legally capable of entering into a binding agreement to use SuiFit.

Where a specific service or feature is intended only for users aged 18 or older, users under that age may not use such service or feature unless SuiFit has expressly provided an appropriate mechanism that complies with applicable law.

When creating an account, you agree to provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account, except where such activities result from a security failure attributable to SuiFit.

You must notify SuiFit promptly if you believe that your account has been accessed or used without authorization.

4. Acceptable Use

You agree to use SuiFit lawfully and responsibly.

You must not:

• Use SuiFit for any unlawful purpose.
• Attempt to hack, disrupt, damage, or interfere with the platform or its systems.
• Access another user's account or personal information without authorization.
• Copy, reproduce, distribute, or commercially exploit SuiFit content without permission.
• Sell, rent, transfer, or share your account or subscription.
• Use automated systems or tools to extract data or content from SuiFit without authorization.
• Reverse engineer, decompile, or attempt to obtain the source code of the software or systems used to operate SuiFit.
• Upload unlawful, abusive, harmful, or infringing content.
• Use SuiFit in a manner that could negatively affect the platform or other users.
• Provide false, misleading, or fraudulent information.
• Use SuiFit to provide medical diagnosis or treatment to another person.

SuiFit may take appropriate action in response to violations of these Terms, including suspending or terminating an account, subject to the user's applicable legal rights.

5. Fitness Services and Medical Disclaimer

SuiFit is a fitness platform and is not a medical provider.

SuiFit's workouts, programs, plans, information, recommendations, and other content are provided for general fitness and educational purposes and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

SuiFit does not provide medical advice.

You should consult a qualified physician or healthcare professional before starting any exercise program, particularly if you have a medical condition, injury, disability, take medication, are pregnant, or have any condition that may be affected by physical activity.

Stop exercising and seek appropriate medical assistance if you experience serious or unusual symptoms, including chest pain, severe shortness of breath, loss of consciousness, severe dizziness, or acute pain.

SuiFit does not guarantee any specific result relating to weight loss, fitness, athletic performance, body composition, or health.

6. Artificial Intelligence

Certain SuiFit features may use artificial intelligence (“AI”) to provide personalized recommendations, generate training plans or content, analyze information, or respond to user requests.

AI-generated outputs may be inaccurate, incomplete, or unsuitable for a particular individual.

AI-generated information provided by SuiFit should not be considered medical advice, diagnosis, treatment, or a substitute for professional healthcare advice.

You are responsible for evaluating whether any recommendation is appropriate for you and should consult a qualified professional where appropriate.

7. Intellectual Property

All intellectual property rights relating to SuiFit, including its name, trademarks, logos, designs, software, interfaces, text, images, videos, graphics, training programs, and digital content, are owned by or licensed to SuiFit unless otherwise stated.

Your use of SuiFit does not transfer any ownership rights to you.

Subject to these Terms, SuiFit grants you a limited, personal, non-exclusive, non-transferable license to access and use the services and content provided to you during your active subscription for personal, non-commercial purposes.

You may not copy, reproduce, publish, distribute, sell, sublicense, or commercially exploit SuiFit content without our prior written authorization.

8. Pricing, Currency and Taxes

Subscription and service prices are displayed before you complete your purchase.

Prices are displayed in Saudi Riyals unless otherwise stated.

Applicable Value Added Tax (“VAT”) and other legally required taxes or charges may be added in accordance with applicable Saudi laws and regulations.

The total amount payable will be displayed before you complete your purchase.

SuiFit may change its prices or introduce new promotional offers from time to time.

Changes in pricing will not affect a prepaid subscription period, except where permitted by applicable law or the specific subscription terms.

9. Electronic Payments

Payments are processed through SuiFit's approved payment service provider, Geidea, together with the payment methods made available at checkout.

Available payment methods may include local and international bank cards, Mada, digital wallets, and other payment methods supported at the time of purchase.

Geidea provides electronic payment services in Saudi Arabia, including support for Mada, Visa, Mastercard, digital wallets, and recurring payments.

Payment information may be processed directly by Geidea or another payment service provider.

SuiFit does not store complete payment card information except to the extent necessary and legally permitted.

Where supported, payment information may be tokenized so that recurring payments can be processed without SuiFit storing sensitive card information.

10. Monthly and Annual Subscriptions

SuiFit offers monthly and annual subscription plans, depending on the plans available at the time of purchase.

Before completing your purchase, we will disclose the applicable:

• Subscription price.
• Subscription period.
• Billing cycle.
• Renewal terms.
• Promotional discounts, if applicable.
• Trial period, if applicable.
• Cancellation terms.
• Refund terms.

Certain subscription plans may automatically renew.

11. Automatic Renewal

Unless you cancel your subscription before the renewal date, your monthly or annual subscription will automatically renew at the end of the applicable subscription period.

By selecting an automatically renewing subscription, you authorize SuiFit and its payment service provider, including Geidea where applicable, to charge the applicable renewal fee to your saved or authorized payment method.

The applicable subscription price and billing frequency will be disclosed before you complete the initial subscription.

The subscription will continue to renew according to the selected billing cycle until you successfully cancel it.

Deleting the SuiFit application or ceasing to use the service does not by itself cancel your subscription.

12. Cancellation of Subscription

You may cancel automatic renewal at any time through the subscription management functionality provided by SuiFit.

After cancellation, you will generally retain access to the service until the end of the period for which you have already paid, unless otherwise required by applicable law or the applicable promotional or refund terms.

Once cancellation has been successfully completed, you will not be charged for a subsequent renewal period.

If you purchased your subscription through Apple App Store or Google Play, you may need to cancel the subscription through the relevant store account settings.

13. App Store and Google Play Purchases

SuiFit may be available through:

• Apple App Store.
• Google Play.

If you purchase a subscription through Apple App Store or Google Play, payment, subscription management, cancellation, and refunds may also be subject to the applicable rules and policies of the relevant platform.

The applicable platform may be responsible for processing refunds for purchases made through its store.

You are responsible for ensuring that your subscription is canceled through the platform through which you purchased it.

14. Cancellation and Refund Policy

SuiFit respects all mandatory consumer rights provided under applicable laws and regulations in the Kingdom of Saudi Arabia.

Refund eligibility depends on factors including:

• The nature of the service.
• The method through which the purchase was made.
• Whether the digital service has commenced.
• Whether the user has accessed or benefited from the digital content or service.
• Any specific refund guarantee or promotional terms applicable to the purchase.
• Any mandatory consumer rights under applicable law.

For digital subscriptions, simply choosing not to use the service after purchase does not automatically establish a right to a refund, subject always to any mandatory statutory consumer rights.

Where a refund is approved or legally required, it will generally be issued using the original payment method where reasonably possible.

15. Purchases Through App Stores

Refund requests for purchases made through Apple App Store or Google Play may be subject to the refund procedures and policies of the relevant app store.

Where applicable, users may be required to submit refund requests directly to the platform through which the purchase was made.

Requests will be reviewed in accordance with this Policy and applicable Saudi laws and regulations.

16. Billing Errors

If you believe that you have been charged twice, charged an incorrect amount, or charged due to a technical billing error attributable to SuiFit or its payment processing system, please contact us at:

We will review the transaction and, where an error is confirmed, process the applicable refund through the appropriate payment channel.

A charge resulting from an automatically renewed subscription that was clearly disclosed and authorized by the user is not necessarily considered a billing error.

17. Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or waive any mandatory consumer right granted under applicable Saudi laws and regulations.

SuiFit aims to comply with applicable Saudi e-commerce and consumer protection requirements, including requirements relating to service provider information, pricing, electronic contracting, payments, complaints, cancellation, and refunds.

18. Privacy and Personal Data Protection

SuiFit is committed to protecting personal data and processing it in accordance with the Saudi Personal Data Protection Law (“PDPL”), its Implementing Regulations, and other applicable data protection regulations and requirements in the Kingdom of Saudi Arabia.

The PDPL provides a framework governing the processing of personal data relating to individuals in the Kingdom, including electronic processing.

This section constitutes SuiFit's Privacy Policy.

19. Personal Data We May Collect

Depending on the services and features you use, SuiFit may collect:

• Email address.
• Phone number, where necessary.
• Account information.
• Subscription information.
• Purchase and transaction information.
• Payment-related information necessary to process transactions.
• Age or date of birth where necessary.

20. Body Images

SuiFit may allow users to upload body images for certain features, including fitness analysis, body composition analysis, progress tracking, or personalized services.

Body images may constitute personal data under the Saudi PDPL.

Depending on the nature of the analysis, additional information may be derived from uploaded images, including information relating to body characteristics, fitness, or health.

Where the processing involves health data or biometric data that falls within the definition of sensitive personal data under applicable Saudi law, SuiFit will apply the additional requirements applicable to such data.

SuiFit will process body images and information derived from them only to the extent necessary to provide the requested feature or for another lawful purpose supported by an appropriate legal basis.

You must not upload images of another person unless you have the necessary legal authority and consent to provide and process those images.

21. Use of Body Images and AI

Where an SuiFit feature uses AI to analyze body images, the images and information derived from them may be processed to provide the requested feature.

SuiFit will not assume that uploaded body images may automatically be used to train AI models or for unrelated commercial purposes.

If SuiFit intends to use body images or information derived from them for purposes such as AI model improvement or product development beyond the provision of the requested service, we will provide appropriate notice and obtain any consent or other legal basis required under applicable law.

Where separate consent is legally required, it will be presented separately and clearly from any consent necessary to provide the core service.

22. Health and Fitness Data

Users may voluntarily provide information relating to their health, fitness, injuries, physical limitations, or exercise history.

SuiFit does not require users to provide health information unless it is necessary for a particular feature or service.

Users should not provide unnecessary health information in fields that do not specifically request it.

Where health information constitutes sensitive personal data under applicable Saudi law, SuiFit will process it in accordance with the additional requirements applicable to sensitive personal data.

23. Purposes of Processing Personal Data

SuiFit may process personal data for purposes including:

• Creating and managing user accounts.
• Providing SuiFit services.
• Personalizing the user experience.
• Creating fitness programs and recommendations.
• Operating AI-powered features.
• Analyzing body images when requested by the user.

24. Legal Basis for Processing

SuiFit processes personal data based on the applicable legal grounds permitted under the Saudi PDPL and its Implementing Regulations, depending on the nature and purpose of each processing activity.

Such grounds may include processing necessary for the performance of a contract, compliance with a legal obligation, a legitimate interest where permitted and subject to applicable requirements, or the consent of the data subject where consent is the applicable legal basis.

Where consent is required, SuiFit will request it clearly and specifically before the relevant processing takes place.

25. Withdrawal of Consent

Where processing is based on your consent, you may withdraw that consent through the mechanisms made available by SuiFit.

Withdrawal of consent does not affect the lawfulness of processing that occurred before the withdrawal.

Withdrawal of consent may result in certain features becoming unavailable where those features depend on the relevant data.

26. Sharing Personal Data With Service Providers

SuiFit may use third-party service providers to operate and improve the platform, including providers of:

• Hosting and infrastructure.
• Payment processing.
• Geidea payment services.
• Subscription management.
• AI services.
• Image processing services, where required.
• Analytics.
• Email and notification services.

• Cybersecurity.
• Fraud prevention.

Personal data will be shared only to the extent reasonably necessary for the relevant purpose and in accordance with applicable legal requirements.

27. Payment Data and Geidea

SuiFit uses Geidea (جيديا) as a payment service provider.

Payment information may be processed directly by Geidea in accordance with its applicable security and privacy practices.

Where supported, Geidea may use tokenization technology to allow recurring payments to be processed using a secure token rather than storing sensitive payment card information with SuiFit.

SuiFit does not intentionally store complete payment card details except where necessary, legally permitted, and appropriately secured.

28. International Data Transfers

Certain SuiFit service providers, infrastructure providers, AI providers, or other technology providers may be located outside the Kingdom of Saudi Arabia.

Where personal data is transferred or disclosed outside the Kingdom, SuiFit will comply with the applicable requirements of the Saudi PDPL and its regulations governing transfers of personal data outside the Kingdom.

This may include applying appropriate safeguards, contractual protections, assessments, or other requirements applicable to the relevant transfer.

29. Data Retention

SuiFit retains personal data only for as long as necessary to fulfill the purposes for which it was collected or for periods required or permitted by applicable laws and regulations.

After the applicable retention period ends, personal data will be deleted, destroyed, or anonymized in accordance with applicable requirements, unless continued retention is legally required or otherwise permitted.

30. Data Security

SuiFit implements reasonable technical and organizational measures designed to protect personal data against unauthorized access, use, alteration, disclosure, loss, or destruction.

Security measures may include:

Opting out of marketing communications does not prevent SuiFit from sending essential communications relating to your account, subscription, payment, security, or services you have requested.

37. Service Availability

SuiFit aims to maintain reliable access to its services, but the platform may occasionally be unavailable due to:

Temporary service interruptions do not automatically create a right to a refund unless required by applicable law or the applicable subscription terms.

If a material change substantially affects an existing paid subscription, SuiFit will handle the change in accordance with applicable subscription terms and mandatory consumer rights.

SuiFit may update these Terms from time to time to reflect changes in laws, regulations, technology, services, or business practices.

Where legally required, material changes will be communicated through appropriate means, which may include email, application notifications, or website notices.

The “Last Updated” date at the top of this document indicates when the Terms were most recently updated.

Continued use of SuiFit after the effective date of an updated version constitutes acceptance of the updated Terms to the extent permitted by applicable law.

40. Suspension or Termination

SuiFit may suspend or terminate a user's account where there is a legitimate reason, including:

• Material violation of these Terms.
• Unlawful use of the service.
• Fraudulent or deceptive activity.
• Abuse or misuse of the service.
• Conduct that threatens the security of SuiFit or its users.

Termination does not affect any rights or obligations that accrued before termination, including any legally applicable refund rights.

To the maximum extent permitted by applicable law, SuiFit will not be liable for indirect, incidental, special, consequential, or similar damages arising from or related to the use of, or inability to use, the service.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under the laws of the Kingdom of Saudi Arabia.

Nothing in these Terms is intended to waive or restrict any mandatory consumer protection rights.

42. Force Majeure

SuiFit will not be responsible for delays or failures in performing its obligations to the extent caused by circumstances beyond its reasonable control, including natural disasters, epidemics, widespread telecommunications or infrastructure failures, government actions, widespread cybersecurity incidents, or other events that cannot reasonably be controlled by SuiFit.

43. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws and regulations of the Kingdom of Saudi Arabia.

Where mandatory consumer protection or data protection provisions apply, those provisions shall prevail over any conflicting provision in these Terms.

44. Dispute Resolution

If you have a dispute with SuiFit, we encourage you to contact us first so that we can attempt to resolve the matter amicably.

If the dispute cannot be resolved amicably, it shall be subject to the jurisdiction of the competent authorities and courts of the Kingdom of Saudi Arabia in accordance with applicable laws and jurisdictional rules.

Nothing in this section prevents a consumer from exercising any mandatory statutory right or complaint mechanism available under Saudi law.

45. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

46. Entire Agreement

These Terms, together with any specific terms presented to you when purchasing a particular service or subscription, constitute the agreement between you and SuiFit regarding your use of the services.

If a specific and clearly disclosed term presented during the purchase of a particular service conflicts with a general provision of these Terms, the specific term will apply to that particular service to the extent of the conflict, unless prohibited by applicable law.
